1. This is an appeal from the judgment of the High Court, Kumasi dated the 18th January, 2010. 2. The facts of this case are that; by a Writ of Summons issued from the High Court, Kumasi on 28th February, 2003, the Plaintiff/Respondent (hereinafter referred to as the Respondent) commenced an action against the Defendant/Appellant (hereinafter referred to as the Appellant) for the following reliefs. 1. Declaration of title for (sic) a 2.27 Acre of land on PLT 14 BLK “A” on Boadi Stool Land, Kumasi is the property of Nana Araba Essibu. 2. Perpetual Injunction restraining the Defendant from occupying any part of the said land without Plaintiff’s approval”. 3.
