GYAESAYOR, JA The judgment, the subject of the appeal emanates from the Land Division of the High, Court, Accra and is dated 15th February, 2012. The plaintiff/appellant (hereinafter called plaintiff) issued a writ of summons against the two defendants on 13th August 2002 claiming;- 1. A declaration that plaintiff is a lessee of all that piece or parcel of land forming part of H/No. B420/7 Awudome estates Accra (The out house). 2. An order restraining the 2nd defendant from erecting a storey building upon plaintiff’s roof of plaintiff single storey building put up in H/No. B420/7, Awudome estates Accra (The out house). 3. Cancellation of any lease agreement purporting to have been made between the 1st and 2nd defendant touching upon plaintiff’s leasehold property in the said H/No. B420/7 Awudome estates. 4.
