ACQUAYE, JA The plaintiff/respondent (hereinafter referred to and called the Respondent) was at all material times the owner of Mercedez Benz Saloon Type E350 with Registration Number GT 9707 Q. The defendant/appellant (hereinafter referred to and called the Appellant) was also at all material times the owner and driver of Nissan Pathfinder with registration number GE 1390 U. On 30th September 2005 at about 11.40am the respondent's driver Richard Appiah was driving the respondent's said Mercedez Benz car on the Third Avenue from Community 5 Extension towards Community 4. At the same time the Appellant was driving his Nissan Pathfinder from Armattoe Road to join the Third Avenue. Both parties agree that the Third Avenue is a major road whilst the Armattoe road is a minor road.
