DENNIS ADJEI,J.A.: This appeal is against the judgment of the High Court, Accra delivered on 2nd June, 2011. The plaintiff/appellant hereafter called plaintiff being dissatisfied with the judgment appealed against same to this court to reverse the judgment. The defendant/respondent would also be referred to in this appeal as the defendant. The brief facts of the case which culminated in this appeal were that the plaintiff took out a writ of summons against the defendant claiming for a declaration of title at North Taifa, recovery of possession, damages for trespass. The plaintiff took the defendant’s grantor to the police station in respect of the disputed land. At the police station, they were asked to submit their respective site plans to the Lands Commission and the results proved that they were on the same land and the land was registered in the name of the defendant’s grantors.
