The plaintiff herein commenced the instant action against the Defendants jointly and severally for the reliefs as set out below: 1. The Recovery of cash, the sum of forty five thousand five hundred Ghana Cedis (GH¢45,500.00) being balance outstanding on a loan granted to the 1st Defendant at her own request and repayment of which the 2nd Defendant secured with property numbered plot 34 Block B, Kumasi. 2. Interest on the said sum at the prevailing bank rate from 30th September, 2012 till date of final payment. Alternatively 3. An order for the judicial sale of property numbered plot 34 Block B, Kromoase, Kumasi used to guarantee the loan. The writ of summons and statement of claim were personally served on the 1st Defendant on 17/01/2013 but the 2nd Defendant could not be served. However, Mathias Gollo Esq. entered appearance on behalf of the two Defendants at a time when the 2nd Defendant had not been served.
