By his amended writ of summons issued from the Registry of this court on 27th May, 2010 the plaintiff, a retired Engineer claimed (a) declaration that the defendant with full knowledge of an encumbrance on Plot No. 10 Block X, Boadi-Kumasi purported to allocate it to him which conduct is unlawful, fraudulent and illegal, (b) general, special, punitive and exemplary damages for defendant’s fraudulent and unlawful conduct. The defendant is the occupant of Huahi Stool. The stool is the customary owner of the lands where the disputed plot is situated. The case of the plaintiff is clearly stated in paragraphs 3 to 15 of his pleadings as follows: “3. The plaintiff states that the defendant allocated a plot known as Plot 10 Block X, Boadi-Kumasi to him which plot turned out to be, to the knowledge of the defendant, the subject of an earlier grant to another person. 4.
