YAA ABRAFI vs. ALLEN OWUSU AND TEACHER NYAME

This is an appeal against the judgment of Konongo District Court presided over by His Worship (Nana) R.A.K. Kpodo. It is dated 6th December, 2011. The judgment was entered for the plaintiff/respondent, to be called simply the plaintiff. The defendant/appellants, to be referred to hereafter as defendants, are dissatisfied with the judgment and have filed the instant appeal. The grounds of appeal contain the omnibus clause that the judgment is against the weight of evidence. Further grounds were filed as follows: 1 That the trial judge erred in putting the burden of proof on defendant/appellants 2 That the trial judge erred in law in holding that the plaintiff had proved his title over the disputed land having come to a firm conclusion that, the defendants were in possession.
