In this suit, the heart of the matter is a document purported to be the last will and testament of one Isaac Darfour Adade alias Kwame Dafour who died on 7th January, 2006. A certified true copy of the document dated 11th April, 2002 is in evidence and marked as Exhibit ‘C5’. The writ was issued from the Registry of this court on 26th June, 2006 wherein the plaintiffs claimed following reliefs: “a. a declaration that the last will and Testament of the late Isaac Darfour Adade aka Kwame Darfour was not signed/or executed by him. b. a declaration that the last will and Testament of late Isaac Darfour Adade aka Kwame Darfour made and date April, 11, 2006 is null and void and of no effect” From the statement of claim, the first and second plaintiffs are widow and daughter respectively of late Kwame Darfour.
