SWALLAH MOHAMMED vs. WESTERN CASTINGS LIMITED

FACTS: On the 11th November, 2013, Swallah Mohammed (hereinafter called "the Complainant”) lodged a complaint of termination at the National Labour Commission against Western Castings Limited (hereinafter called "the Respondent"). Complainant's submissions: The Complainant submitted that his appointment as a Painter was terminated because, he attended his mother's funeral on a day which was even his off day. He stated that the Respondent made it known to him that she did not need his services any longer. The Complainant also submitted that the Respondent never paid his SSNIT for the ten years he worked despite all efforts to get her to pay. The Commission in letters dated 12th November, 2013 and 13th January, 2014, forwarded the complaint to the Respondent for her response in accordance with L.I. 1822.
