BARBARA ACKAH-YENSU, JA The Defendant/Appellant has filed the instant appeal against the judgment of the High Court sitting in Cape Coast, and dated 30th July, 2010. The said court gave judgment in favour of the Plaintiff/Respondent. The brief facts of the appeal are that on 19th July, 2007, the Plaintiff/Respondent filed a suit against the Defendant/Appellant for a declaration that he was entitled to be paid an amount of ¢226,080,000.00 for lotto tickets he staked and won. He thus prayed for the court to make an order compelling the Defendant/Appellant to pay the said amount to him, together with interest. The trial High Court Judge opined thus: “I therefore conclude that it is abundantly clear that there was no justification on the part of the Defendant Company to refuse to pay the amount plaintiff put in a claim for.
