KANYOKE, J.A.: On the 26th day of September 2007, the Plaintiff/ Respondent (hereinafter referred to as the plaintiff) took action against the 1st defendant and the 2nd Defendant/Appellant (hereinafter called the 2nd defendant) jointly and severally claiming the following reliefs: “a. A declaration that H/No. 12 (labeled Plot No. B.16) Augustino Neto Road Airport Residential Area, Accra, is the bonafide property of the plaintiff having acquired same from Product ion Engineering (West Africa) Ltd. by a contract o f sale dated 18th May 2007 and subsequent assignment dated 5th June, 2007. b.
