FRANK MULLER vs. EOCO & ORS

RULING On the 25th of November 2013, upon an application for a defreeze brought by the respondent herein, the court under Section 38 of EOCO Act 2010, Act 804 granted the application. The respondent herein complying with the Court’s Order, payment of the tax on the amount, proceeded to the Bank to withdraw the monies but was refused. Learned counsel for the respondent then filed contempt proceedings against the Bank’s Management. On the 18th day of December 2013, the court gave its ruling on the contempt application brought against the Bank. There was an interesting development when the ruling on the contempt was to be read. Learned counsel drew the court’s attention to a motion for the arrest of the ruling Slated for 7th January 2014. I asked counsel for applicant herein the Order under which he was coming, but he could not give any authority to that. He only said under my inherent jurisdiction.
