NUMO SAMUEL ADJEI SORSEY OBLIE vs. MENSAH SOWA KODIE & ORS

JUDGMENT On the 10th day of February 2010, the plaintiff issued a Writ against the following:- 1. Mensah Sowah Kodia 2. Adjei Okpoti Massey 3. Lands Commission Through the proceedings, the 3rd defendant, Lands Commission never appeared to contest the matter. The 2nd defendant testified. In-fact, he had been attending Court. He said he represented the 1st defendant in the Court. The 3rd defendant entered appearance, field on the 13th day of February 2010, the Solicitor, Yaw Awuku Asabre. The only defence filed on behalf of the 3rd defendant is as follows:- (1) The 3rd defendant is not in position to admit or deny paragraphs 1 – 8 of the Statement of Claim; Then, the 3rd defendant filed a general traverse as follows:- “2’ Save as hereinbefore expressly admitted the 3rd defendant denies every allegation set out by the plaintiff in his claim as if same were set out in extensor and denied seriation”.
