NELSON MARTEY vs. MARY DZAGBLE

RULING This application has been brought when the Curt was about to deliver its Judgment. I must say, it has been the diligence of the Plaintiff that is why this case is still pending. Now, they are asking for an amendment of the Writ of Summons and Statement of Claim. The argument of the defendant amongst others is that the plaintiff’s action will amount to setting up an entirely new case. My answer to this is that, the rules allow such. See Order 16 r 15 of CI 47. The inordinate of the plaintiff notwithstanding, I will grant the amendment to be done within (3) three days of this ruling. If any party needed to call further evidence, this will also be granted. I however award cost of One Thousand Ghana Cedis (GH¢1,000.00) to the defendant. Application granted.
