EMMANUEL KINGSLEY APPIAH vs. SCANCOM LIMITED, LINUS OCLOO, BENJAMIN OCLOO
The plaintiff, Emmanuel Kingsley Appiah sued the 1st defendant Scancom for erecting its mast on a land he claim belongs to him. The 2nd and 3rd defendants joined the action. Mr. Linus Ocloo and his son Benjamin Olcoo joined because, they say the land is for them and had allowed Scancom to erect the mast. Linus Ocloo said the said plot of land was purchased by him and gifted to his son, the 3rd defendant. During proceedings, when judgment was to be delivered, the learned counsel for E.K Appiah prayed the court to amend his writ of summons. The first writ had the following on its endorsement 1. A declaration that defendant has wrongfully mounted their mast on plaintiff’s land situate at West Akweteman Sonutuom, the schedule of which is set out in the statement of claim. 2. An order directed at the defendant to remove the said mast from plaintiff’s land. 3.
