JUDGMENT This is an application brought under Section 110(1) and 111 of the Alternative Dispute Resolution Act, 2010 (Act 798), for the registration and enforcement of a settlement (Customary arbitration) award. Section 110 (1) of Act 798 provides: “A customary arbitration award may for the purpose of record and enforcement be registered at the nearest District Court, Circuit Court or the High Court as appropriate”. It is also provided by Section111 of Act 798 that: “An award may be enforced in the same manner as a judgment of the Court”. to It is trite that negotiated settlement is classified as a customary arbitration. Thus customary arbitration includes negotiated settlement. See section 133 of Act 798. The settlement award being sought to be registered and enforced by the applicant is dated 9th February 2005.
