JUDGMENT The Plaintiffs are authors of the French La Source Books and the Defendants are the publishers of the said book. The Plaintiffs had in a previous suit commenced in the Commercial Court claimed against the Defendant damages for breach of the agreement between the parties. In that suit, the Plaintiffs had sued for a declaration that the Plaintiffs were entitled to their respective percentage of the net selling price and not the net selling profit for copies of the La Source books and an order for accounts among other reliefs. The Defendant in that suit had also sued the Plaintiffs in another suit before the Fast Track High Court claiming damages for libel in respect of certain publications, an order for retraction of the said publications and a perpetual injunction restraining the Defendants therein from further publications of defamatory material.
