By its amended writ of summons filed on 4th April, 2011, the plaintiff church claimed against the defendants, (a) declaration of title of a plot of land referred to as Number 22 Block 11, Ehwimase, Kumasi, (b) Damages for trespass, (c) recovery of possession of the said plot and, (d) perpetual injunction against the defendants, their assigns and workmen from interfering with plaintiff’s right to the enjoyment of the land. On 13th February, 2014, the 3rd to 22nd defendants brought a motion on notice praying for an order to join the Lands Commission as the 23rd Defendant. The grounds for the motion are stated in paragraphs 3 to 6 of the affidavit sworn to by the 8th defendant in support of the motion for joinder in the following terms: 3.
