JANET FRIMPOMAA AND OSEI KOFI vs. ASANTE AKIM NORTH DISTRICT ASSEMBLY AND 6 OTHERS
On 29th July, 2014, the court delivered judgment in this suit and deferred its reasons to be given today. I now assign reasons for the position I took on 29th July, 2014. In doing so, it is relevant to recap the reliefs claimed by the plaintiffs, who are described as the grand children of one Adwoa Boakyewaa, also known as Susana Boakyewaa. Susana Boakyewaa who died in 1988 is presented by the plaintiffs as one of the founders of the Presbyterian Church in Asante Akim Domeabra. The plaintiffs claimed two reliefs per their writ of summons issued from the Registry of this court on 13th September, 2007. They are: (i) ¢110,000,000.00 or GH¢11,000.00 special damages being the amount expended in constructing a four bedroom house, kitchen, toilet and bathroom, two verandahs on a portion of H/No PM2, Asante-AkimIDomeabra which said building was wrongfully demolished by the 3rd to 7th defendants acting for themselves and on behalf of the 1st and 2nd defendants.
