KOFI AMANKWA (SUBST. BY) KWABENA OPOKU AND NANA KWAKU ATUAHENE vs. DR. ERNEST ANTWI

This writ of summons was filed in the Registry of the court on 22nd April, 1993 in respect of House Number Plot OTB 604, Odum, Kumasi and, a cocoa farm situate at a place commonly known and called “Akwaasu” on Ankase Stool Land. In the pendency of the suit, the original parties passed away and were substituted by the current ones. The original 1st plaintiff described himself as the customary successor of one Isaac Cobina Antwi, deceased, who is alleged by the defendant to have put up the disputed house and owned it as a self-acquired property. The 1st plaintiff averred he sued with the authority of his family, for himself and, on behalf of the family. The 2nd plaintiff claimed to be the Gyaasehene of Ankase. He alleged he joined the action with the consent of the elders of Ankase stool to claim and protect the stool’s interest in the disputed house.
