KOFI AMANKWA (SUBST BY) KWABENA OPOKU vs. DR. ERNEST KOFI ANTWI
This is a ruling in respect of a motion on notice by the defendant/applicant, to be referred to simply as the defendant, for leave to amend his statement of defence as well as the counterclaim to include an additional relief. The thrust of the application is captured in paragraphs 5 and 6 of the affidavit in support, details of which are in the following terms: “5. That the defendant seeks to amend the statement of defence by deleting “That” preceding paragraphs 16, 17, 18, 19, 20, 21, 22, 23, 24, 25, 26, 29, 30, 31, 34, 35, 36, 38 and 39; replacing “That he” preceding paragraphs 32 and 37 with “Mr. I. C. Antwi’s” and correcting paragraphs 27, 28 and 33 of the statement of claim (defence) which shall read as follows: 27. The late Isaac Cobbina Antwi put up his house on the plot and gratuitously accommodated Elders of Ankasse stool and other visitors in one room he used as a guest room on humanitarian grounds. 28.
