MARGARET WELBOURNE (JA) This appeal is against the judgment of the High Court, fast Track Division dated 2nd December 2008. The Facts The plaintiff/respondent (hereinafter referred to as the Respondent) was a business woman whose mother was Dr. Evelyn Vanderpuye. It was the Respondent’s case that her mother who died on 2nd November, 1990, acquired the land from the Nungua Stool in the late '70s. She obtained a lease agreement from the Nungua Stool in 1979 and registered same in 1992. After the mother’s death, she noticed that someone kept removing the pillars that her mother had put in place on acquisition of the land. The respondent constructed a two-room structure on the land and put in two caretakers to live in the said structure. She got to know Dr. Maxwell Appeagyei, the 1st Defendant/appellant when he started development on the land. 1st Defendant brought in blocks, sand, chippings and constructed a wooden structure on the land.
