A.M. DORDZIE, JA: The appellant herein was the plaintiff in a suit he took out against his employers in the High Court (Industrial & Labour Division) Accra. He was the branch manager of the defendant company, Speedline Stevedoring Ltd at its Tema office. In November 2008 the defendant wrote transferring plaintiff to its offices in Takoradi to take over the office of the branch manager in Takoradi. The plaintiff declined the transfer and requested that he be given the opportunity to explain why he would not accept the transfer. In response to the plaintiff’s refusal to go on transfer the defendant in December 2008 wrote requesting him to resign his position in the company in accordance with the terms of the Collective Bargaining Agreement between the parties. The plaintiff declined this request and insisted that if his employment with the defendant should come to an end under the circumstance then it should be on condition of redundancy.
