JUDGMENT On 19th February 2013, the applicants, through their lawyers filed an originating motion on notice to enforce their fundamental human rights as guaranteed by chapter five of the 1992 constitution. In support of the motion was a 31 paragraph foundation affidavit. A number of reliefs were sought by them and the grounds upon which the application was premised were set out with clarity. On 28th March 2014, an application for leave to amend the motion paper was filed on behalf of the applicants by their lawyer. The application to amend sought to amend the reliefs being claimed, the grounds of the application and the list of the applicants by the deletion of names which had been duplicated and the deletion from the list of applicants the names of those who had opted out of the case. The application to amend was not opposed by counsel for the respondents. Upon leave being granted, an amended notice of motion pursuant to leave granted was filed on 22nd April, 2014. A...
