J.N. ANNANG vs EMELIA LAWORYOR ADJEI, EMMANUEL MENSAH AKRONG

JUDGMENT The central issue that arose for determination in what appeared to be a family feud was whether the land in dispute was acquired by the plaintiff from his personal resources or jointly with his deceased brother or whether it was acquired solely by the plaintiff’s deceased brother for the extended family. The plaintiff, J.N Annang, and the 1ST defendant, Emelia Laworyor Adjei, are siblings. The 2ND defendant, Emmanuel Mensah Akrong, is the son of the 1ST defendant and therefore the plaintiff’s nephew. On 24TH December 2013, the plaintiff issued a writ of summons against the defendants for declaration of title to land, recovery of possession and damages for trespass. It appears that this action was taken as a last resort to bring finality to a prolonged and intractable family dispute.
