The Accused is charged with the following offences; 1. Count one; providing Electronic Communication Service without Authority contrary to section 3(1) and 73(1)( c) of the Electronic Communications Act, 2008 (Act 775) 2. Count two; Possessing illegal device contrary to section 135 of the Electronic Communications Act, 2008 (Act 775) 3. Count three; Knowingly obstructing and interfering with the sending, transmission, delivery and reception of communication contrary to section 73(1)(e) of the Electronic Communications Act, 2008 (Act 775) The facts of the case which were attached to the charge sheet and read in open court are that based on signals received on sim boxing activities going on at Koforidua, on the 9th of January, 2015, a joint anti-fraud taskforce of the National Communication Authority, Ghana Police Service and the Telecom Operators embarked on an operation in Koforidua.
