DR. EKOW AKYEAMPONG vs. MADAM ABENA ATAA AND AKWASI TAWIAH

The plaintiff, Dr. EkowAkyeampong, described himself as a retired agronomist. He asserted in this action that he bought a parcel of land from the chief of Toase in 1991but the defendants, who are natives of Toase,are unlawfully farming on it. Hetherefore instituted the instant action claiming the following reliefs against the defendants: (1) Declaration of title and ownership to twenty(20) acres of land being bounded on all sides by the properties of Toase Medical Centre, a lorry park, Kumasi-Bibiani road and a teak plantation. (2) Recovery of possession (3) Damages for trespass (4) Perpetual injunction to restrain the Defendants, their agents, workmen and assigns from entering the land. According to him, he was issued with an allocation paper and site plan in 1999 in respect of the property which measures up to twenty (20) acres, subsequent upon which a lease was executed between him and YimAwere Stool of Toase, confirmed by the Asantehene, dated 8th April, 2003 with title N...
