HONYENUGA, J.A. This is an appeal by the appellant against his conviction and sentence by the High Court, Cape Coast dated the 28th day of July, 2005. The appellant was charged with Robbery contrary to section 149 of the Criminal Offences Act 1960 (Act 29) as amended by the Criminal Code Amendment Act, 2003, Act 646. He was convicted and sentenced to 45 years IHL. The facts of the case on which the trial was mounted were that on the 9th of February 2002, robbers invaded the house of Rev. Father Robert Dawson Amoah at Cape Coast amid gun shots. The robbers who wore masks, except one dressed in camouflage shorts and a black ‘T’ Shirt, ransacked the rooms of the house. The robber who did not wear the mask shot at the thigh of Rev. Father Dawson Amoah and in the course of the robbery, the victim heard some of the robbers calling the name of the robber who did not wear the mask and shot at his thigh as “Togbe”.
