MAKWEI AMEDEGBE vs. THE REPUBLIC
L. L. MENSAH, J.A. This is an appeal launched by the Appellant who was convicted on 30th April 2002 by the High Court, Ho for the offence of robbery and found guilty by the jury. After conviction, the Appellant was sentenced to life imprisonment. As aforementioned, the Appellant was charged with robbery contrary to section 149 of Act 29/60 as amended by NLCD 398 paragraph 6. The particulars of the offence is that the Appellant, a fitter, on the 11th day of December, 2000 at Srogbe in the Volta Region for the purpose of stealing an amplifier, a tape recorder and cassettes and ₵2 million cash caused harm to one Emelia Apetorgbor with intent to prevent her resistance to the stealing of the money and the other gadgets. The Appellant from the Record of Appeal is however not appealing against the conviction, but pleads for mitigation of sentence.
