JUDGMENT Before I proceed to read my judgment I wish to make this comment; that Counsel for Plaintiff submitted his address on Thursday the 19th May 2016 when this judgment was ready and was to be read the following day Friday 20th May 2016. I have had to address some of the issues raised in Counsel’s address which may have resulted in some repetitions in sections of this judgment. I wish to therefore crave your indulgence as I proceed to deliver this judgment. Plaintiff issued a writ against the Defendants on 23rd February 2012. By an Amended Writ of Summons and Statement of Claim with leave of the court, Plaintiff filed for the following reliefs: 1. Declaration of title in favour of the E. B.
