RULING By a writ of summons the plaintiff claims against the defendants a. An order for recovery of the sum of GH¢35,101.36 being loan advanced to the 1st defendant. b. Interest on the said sum at the prevailing bank rate from 19th October, 2015 till date of final payment. c. An order of Judicial sale of the 1st defendant’s unregistered Chevrolet Cruz vehicle with chassis number 1G1PC5SH4C7305172 and 2nd defendant’s KIA SPORTAGE ST/WAGON with registration number GW 1912-15. It appears from the records that the defendants were served with the writ and the accompanying statement of claim on the 18th March, 2016. However, there is nothing on record to indicate that the defendants have entered appearance to the writ. By a motion ex parte the plaintiff therefore seeks an order of the court to enter judgment in default of appearance in favour of the plaintiff against the defendants for the reliefs endorsed on the writ of summons.
