JESSIE WOETSA NYAFLI FLAMMER AND NII NGLESHIE ADDY V vs. KOFI AGYEMANG AND PAYTEL CO. LTD

RULING The root of this suit can be traced to a judgment delivered by the High Court presided over by my brother Justice Peter Bright Mensah on the 17th day of January, 2013 in favour of the Defendants herein. The parties in that suit are the same as in this suit. That suit was Suit No. BL/746/2005. The Defendants therein traced their title to the Odai Ntow family of Ashongman. The Plaintiffs in Suit No. BL/746/2005 claimed against the Defendants declaration of title to land as described in the schedule in the present statement of claim and damages for trespass, among others. Simply put, the Plaintiffs therein, who are the Plaintiffs herein, claimed against the Defendants therein (who are the Defendants herein) declaration of title over the same parcel of land as described herein. The Defendants in that suit (who are the Defendants herein) also counterclaimed against the same Plaintiffs for ownership of this land.
