JUDGMENT The plaintiffs, Nene Narh Adrah and Peter Ashiatey Chartey in their capacities as joint heads of the Nene Martey Chartey Awah Stool family of Kordiabe brought this action against the defendant, Apostle Sarah, for a declaration of title, recovery of possession, damages for trespass and perpetual injunction to restrain her from dealing with the land in dispute. The plaintiffs’ case as gleaned from their amended statement of claim was that their great grandfather Nene Chartey first settled on the land in dispute and engaged in farming and hunting. He leased sections of the land to individual developers and granted licenses to others to farm thereon. According to the plaintiffs in 1974, Nene Chartey Awah III, the Paramount Chief of Shai and a member of the Lekpedzedom Royal family leased 640 acres of the family’s land located at Ayikuma to one K.A.
