On the 26th of July, 2016, the court ordered the defendants/Applicants to file their written submissions within 21days in respect of the two applications filed by them. The record before me clearly shows that the defendant/Applicant have failed to comply with the order of the court directing them to file their written submission. I have been shown a copy of a written submission filed by Applicant Counsel in respect of the Motion for the suspension of the order of the court dated 9th May, 2016. This submission was filed on the 17th October, 2016. Today is 1st November. The order was made on the 26th July, 2016 for Applicant to file their submission. In my view, Applicant have failed to move the court in respect of their motion which seeks to struck out the names of 2nd 3rd & 4th defendants. Accordingly, the Application seeking an order to strike out the names of the 2nd 3rd and 4th defendants from the suit is hereby struck out for want of prosecution.
