This is an application for interim injunction to restrain the defendants/respondents from convening the meeting of the 1st defendant for any purpose what so ever and in particular for the removal of the plaintiff as a director of the 1st defendant company as a director of Calt Cocoa International Company Limited and a director of Nsawam Cannery Ltd. Counsel for the 1st defendant/respondent informs the court she is not opposed to the application. I have read the application and the supporting affidavit. I have also considered the statement of case filed by the applicants counsel. Regard has been given to the relevant provisions of the Companies Act, (Act 179) and the principles governing the grant or otherwise of applications of this nature. I am of the view that the justice of the matter requires me to grant the application as the status quo should be preserved pending the final determination of the substantive matter.
