The desire to honour the dead in our society by the attendance of funerals of people we know has been with us since time immemorial. It is difficult for one to envisage that the magnanimity of making a donation at one such funeral can result in an embarrassing law suit. The present action, to me is a needles litigation, though it raises issues of banking. During the funeral of Nana Kweigya Ankomah III of Elmina, Dr. Papa Kwesi Nduom made a funeral donation to the family of the deceased. The donation was not cash but cheque. The Plaintiffs alleged that they were detailed by the family to cash the cheque. Upon presentation of the cheque at the office of the Defendant’s branch at the Cape Coast (Main) Branch, they were instructed to open an account as the face value was high. Having opened the account, the Plaintiffs returned some days after to withdraw the money, only to be told that their accounts has been credited with GH¢500.00 on the instructions of Dr. Papa Kwesi Nduom.
