REPUBLIC vs. THE DISTRICT COURT, BOLGATANGA; EX PARTE MATILDA APANA (APANA AGANDAA – INTERESTED PARTY)

This ruling is in respect of an application filed by one Matilda Apana, wife of the Interested Party, praying for an order to bring up and quash by writ of certiorari the decision of Bolgatanga District Court, sitting as Family Tribunal, on 21/08/14 and presided by Her Worship Mrs. Vivian Lariba Yamusah. The decision of the Tribunal concerned the setting aside of its earlier consent judgment entered on 17th May, 2011.The consent judgment arose when the applicant herein dragged her husband to the Family Tribunal in respect of maintenance for the five children of their marriage. The Tribunal in its wisdom referred the matter to the Alternative Dispute Resolution (ADR) officer attached to the District Court, one Hamid Abdal Umar, for out of court settlement.
