The Plaintiff contracted the 1st Defendant in 2009 for security guard services at his premises, including protection of personal property, for which he paid fees. During the contract, the premises were burglarized while the 2nd Defendant was on duty, resulting in loss of money, electronics, clothing, and other items. Some items were recovered after arrests. Plaintiff alleges breach of contract and negligence by Defendants causing his loss and sues for damages and declarations.

The Defendant charged the Plaintiff a fee for the provision of this service. Plaintiff claims that while this contract was in force, his premises were burglarised on a day that the 2nd Defendant was the security guard on duty resulting in the loss of some large sums of money, electronics, clothing and other personal items of the Plaintiff. Some arrests were subsequently made in the case and a few of the items were retrieved. Plaintiff however contends that the Defendants breached the contract.
