This is an application by Defendants/Applicants herein (hereinafter, “Defendants”) praying for an order of variation of the Order entered by Justice Charles Quist dated 6th day of November, 2013, (hereinafter, the “6th November, 2013 Order/Order”). Detailed in the affidavit accompanying the motion paper are the following facts, which, according to the Defendants gave rise to the instant application. It is the case of the Defendants that certain complaints of alleged misconduct levelled against Plaintiff/Respondent herein (hereinafter, the “Plaintiff”) by the 1st Defendant were lodged with the Governing Council of the 2nd Defendant College and a committee was set up to investigate the matter.
