JUDGMENT Procedural History This suit has had a chequered history for the eight years it has been in the courts. The original suit was filed by the plaintiff on 12th May 2010. It started as a matter between the plaintiff, some of his siblings and the defendant counterclaimant over the sale or purported sale of their mother’s house to the defendant counterclaimant. The plaintiff initially sued the defendants for inter alia, a declaration that the purported sale of the said house to the defendant counterclaimant was null and void. The defendants entered appearance and in their amended statement of defence and counterclaim filed on 13th July 2011, they counterclaimed against the plaintiff for the following reliefs: i. An order for the recovery of possession of all that premises known as H/No. C251/10, Accra New Town from the plaintiff. ii. An order restraining the plaintiff from interfering with the said premises. iii. An order against the plaintiff to account for all rent.....
