MRS SHIRLEY ANNA ADDINGTON vs. DHIRA J. J. LAKHIANI & 2 ORS

JUDGMENT The Plaintiff issued this Writ of Summons against the Defendants in her capacity as the widow and Administratrix of the Estate of her late husband Paul Augustus Addington who died intestate in the United Kingdom where they were both domiciled. The 1st Defendant is the successful purchaser of the property at an auction. I will describe him as the Defendant in this case because though 2nd and 3rd Defendants were served by substitution they never entered appearance nor filed any Statement of Defence. No interlocutory judgement was taken against them either. 2nd Defendant was the judgment creditor in Suit No. RPC/263/07 in whose favour the property was attached and auctioned. The 3rd Defendant was the judgment debtor who was a tenant in the house the subject matter of the auction. Plaintiff says her husband acquired the subject matter in dispute known as No. 9 Walnut Street, Teshie Nungua which was acquired from the State Housing Corporation in 1983.
