JUDGMENT This suit was commenced with a writ of summons and statement of claim on the 8th of December, 2010 against the 1st and 2nd Defendants initially. This matter has previously been handled by two other judges but same was transferred to the instant court by an order of the Honourable Chief Justice dated 20th February 2015 by which time it was part-heard and as such, the new rules of evidence laid down under the High Court (Civil Procedure) (Amendment) Rules, 2014 (C.I.87) were not applied, accounting partly for the delay in the determination of this matter. The Plaintiff, subsequently applied for and obtained an order for joinder of the 3rd Defendant and then amended the reliefs sought in the following manner; Wherefore Plaintiff claims against Defendants jointly and severally as follows; (a) An order declaring Plaintiff as the owner of the land in dispute.
