AFRICAN AUTOMOBILE LIMITED vs ATTORNEY GENERAL
RULING The plaintiff in this case issued a writ against the defendant for: (i) A declaration that the Ministry’s decision to refuse to settle the account and take receipt of the 110 Galloper vehicles imported by Plaintiff as agreed is wrongful. (ii) An order directed at the Government of the Republic of Ghana to pay to Plaintiff the sum of US$2,301,940 being the balance of the contract sum owed Plaintiff as at October, 2001. (iii) Interest on the aforesaid sum from October 2001 when the aforesaid sum became due until the date of final payment at 1% per month compound as stipulated in paragraph (c) of the Ministry’s letter dated 10th January 2000. (iv) Collateral damages including: (v) Loss of Mitsubishi franchise and consequential damages (a) Loss of Barclays bank facility of US$4 million (b) Sale of mortgaged properties by Barclays Bank of Accra (c) Storage and maintenance of the 110 Gallopers (e)Pilferage of the 110 Gallopers (f) Executive loss of time.
