JUDGMENT INTRODUCTION: This is a dispute over ownership of a piece of land which adjoins 1ST defendant’s residential property at McCarthy Hill, Accra. 1ST plaintiff, Assemblies of God Church Ghana, Faith Chapel, McCarthy Hill, appears to be a branch of the Assemblies of God Church Ghana, which has its place of worship at McCarthy Hill, Accra while 2ND plaintiff is the head of the Gbawe Kwatei family of Gbawe. The said family are owners of a vast stretch of land which encompasses the area known as McCarthy Hill. 1ST defendant is a pharmacist, who acquired land at McCarthy Hill in the 1970’s while 2ND, 3RD and 4TH defendants are vehicle mechanics whom the 1ST defendant permitted to ply their trade on the piece of land in dispute. FACTS: By an indenture dated 12TH June 2015, 1ST plaintiff acquired the land in dispute from 2ND plaintiff’s family.
