JUDGMENT The plaintiff, Captain Kwaku Nimo, a home owner, sued the defendant, Parakuo Estate ltd, a real estate developer, for the following reliefs; a) Specific performance of the contract to build, sell and deliver to plaintiff an NR 3 type house at Parakuo Estates Dome Accra, free from material and workmanship defects which defendants negligently and fraudulently failed to do b) In the alternative, damages of such amount that would enable the plaintiff acquire the same type of house in a comparable area to the one in which House No. PE 116 Parakuo Estate is located c) Payment of the cedi equivalent of one thousand U.S dollars (1,000) per month as rent from 1ST September 2009 until the date of delivery of the replacement house.
