HFC BANK GHANA LTD vs. CLASSFAM GHANA LTD AND OBENG AKROFI

JUDGMENT Per their writ of summons dated the 25th day of March, 2011 the Plaintiff claims the following reliefs against the Defendants: 1. An order for the recovery of GH¢434,823.50 being as at 1st March, 2011, the outstanding balance of the facility advanced to the 1st Defendant. 2. Interest on the amount of GH¢434, 823.50 form 2nd March, 2011 to the date of final payment at the agreed rate of interest. 3. Alternatively judicial sale of a landed property lying and situate at Korkordzor, Accra and used by the 2nd Defendant to secure the facility from the Plaintiff. 4. Other just and equitable reliefs. 5. Cost. There is evidence before me that even though the Defendants are aware of the pendency of this case they have refused to attend court to contest Plaintiff’s claim for which reason the Plaintiff was ordered to mount the box and prove their claim.
