KOFI AGYEMAN MENSAH & ANOR. vs. SAEED MARFO & ANOR.
JUDGMENT Per their writ of summons dated the 5th day of August 2011 the plaintiffs are seeking the following reliefs against the defendants. 1. A declaration that all that parcels of land described herein belong to plaintiffs. 2. A declaration that defendant fraudulently obtained an assignment of the land and fraudulently registered same in their favour. 3. An order setting aside the registration of the said land. 4. An order for recovery of possession of all that parcel of land being occupied by the defendants. 5. An order of perpetual injunction against the defendant, his agents, workmen, assigns, privies etc. restraining them from selling or mortgaging or clogging the land in any manner whatsoever to third parties. 6. Costs. It is salient to note that even though the defendant is aware of the pendency of this suit he failed to attend court to contest same for which reason the court proceeded with the trial in his absence.
