The Plaintiff, Rev. Jakes Kwarteng Acheampong, claimed title to approximately 4.13 acres of land at Nmai Dzorn, Teshie, Greater Accra, alleging he leased the land from the 1st Defendant, Nii Jacob Okpelor Ablor Mensah, who acted as grantor. The Plaintiff alleged that after acquiring the land by deed of lease dated 16 July 2013, he took possession and erected boundary pillars. He successfully sued a trespasser, Ampofo Adusei, with the 1st Defendant testifying in his favor. Subsequently, the Plaintiff discovered discrepancies in the site plan and engaged the 1st Defendant to execute a supplementary agreement to correct the land description. Despite this, the Defendants allegedly trespassed and commenced building on the land, prompting this suit for declaration of title, damages, injunction, recovery of possession, and demolition of structures. The Defendants contended that the land granted to the Plaintiff was different from that granted to the 2nd and 3rd Defendants and alleged irregularities in the Plaintiff's acquisition and site plan preparation. The Defendants failed to attend court to contest the claim on multiple occasions.
