JUDGMENT Introductory background [1] This is an appeal from the decision of the Circuit Court, Accra dated on 11 August 2016. [2] The brief facts of the case are that the Complainant, Emmanuel Ashie is a driver who lives at Teshie while the Appellant, John Appiah a.k.a Kwabena Appiah is a mason who lives at Assin Manso in the Central Region. On 10 June 2016 at about 12 midnight, the Complainant was driving a KIA Picanto taxi with registration number GR 2273 – 16 when the Appellant and his accomplice who is now at large, stopped him in front of International Trade Fair Site, La. The Appellant and his accomplice asked the Complainant to take them to Labone at a fare of GHȼ10. The Appellant then instructed the Complainant to come out of the car and place their load in the boot. As the Complainant packed the load into the boot with the car engine on, the Appellant and his accomplice took advantage of him, entered the car and started to move.
