JUDGMENT Introductory background [1] This is an appeal from the decision of the Circuit Court, Accra dated on 9 February 2015. [2] The brief facts of the case are that the Complainant, Justice Andoh is a banker at Dwetire Microfinance located at Haatso/Accra whilst the Appellant, Kelvin Nkansah is a driver’s mate and lives at La/Accra. On 5 February 2015 at about 2:00am, the Appellant broke into the Complainant’s office causing damage to the sliding window glasses and ceiling and entered the office. The Appellant stole certain items from the office and thereafter hired a taxi driven by a witness in this case to convey the items to Circle. The driver after loading the items became suspicious and began questioning the Appellant as to how he came by the items.
